CLEVELAND - Jurors in the trial of a man who was accused of taking part in a deadly downtown robbery and shooting, watched surveillance video of the moments leading up to the crime in court on Wednesday.

Joaquin Hicks, 29, faces eight counts on charges including: aggravated murder and attempted murder.

Hicks' attorneys say investigators have the wrong man and that he was at home the night the shooting happened.

At his trial, prosecutors played surveillance video from inside Scorchers sports bar on East 12th Street. The video was taken in the minutes before Jory Aebly, 26, and Jeremy Pechanec, 28, were shot in the head after attending a co-worker's birthday party. Jory survived, Jeremy died.

"The video is showing the three...Jeremy, Rodney and DaQuan had just been to the ATM right there," explained Cleveland police homicide detective Raymond Diaz.

It's hard to see, but prosecutors say the video shows Jeremy after he withdrew $260 from an ATM, allegedly to buy marijuana.

Prosecutors say walking behind him were Rodney Rhines, who was panhandling for money to buy crack, and a man known as "DaQuan" who prosecutors say is actually Joaquin Hicks, the man now on trial.

"There is an argument right now between Jeremy and DaQuan over Jeremy, accusing him of possibly taking his ATM card," explained detective Diaz.

The argument is settled. Prosecutors say the video shows Jeremy Pechanec go back inside the bar and buy a round of drinks for all three.

"He had just walked in like I said...you'll see the person in the black coat and red shirt, who that night we were told was DaQuan," said Diaz.

Prosecutors say DaQuan is seen pointing out Jeremy to three other men, who had devised a plan to rob him. Then they say he is seen dancing, excited about what was about to happen. They also say DaQuan hung around Jeremy, Jory and their friends all night.

"The person that's DaQuan just went to the table where Jory and them are," said Diaz.

Jory Aebly is rarely seen on the video. At one point, he is seen going to the restroom.

At the end of the night, a camera outside shows Jeremy, DaQuan and the admitted crack addict, leave.

Guests at the nearby Embassy Suites say they listened as Jeremy and Jory were shot in a park across the street.

"It went pop, pop, then a little hesitation, then another pop," said one hotel guest.

Cuyahoga County coroner Dr. Frank Miller testified the Jeremy Pechanec did not have any traces of marijuana in his system.

Judge Daniel Gaul replaced one of the jurors with an alternate because that juror was apparently falling asleep during Wednesday's testimony.
